Overview
We do a comprehensive test on our hire fleet at least annually to keep our hire fleet in good working condition. Generally, we don’t have any issues with our hire equipment as we do our own maintenance and have a reasonable hire fleet of standard, pull-apart and portable scooters, powerchairs, rehab chairs etc.
Our portable scooters and powerchairs have been on local and international cruises, flown to and used in different cities in Australia, as well as Asia, and been on extended road and rail trips to different parts of Australia.
We have had thus far had no major breakdowns that have not been able to be rectified remotely and thus far have not caused any major issue or have not had an adverse impact on our client or ourselves.
In saying the above, on our local hires as this is predominantly our coverage area, we have had instances with our hire equipment tripping because of a battery collapsing, batteries failing to hold charger due to lifespan or other operating faults (it’s not feasible to run battery discharge test on every unit before hiring out), battery chargers failing due to power surges, and thereafter equipment stopping because it has not to be charged correctly, ignition keys being lost, flat tyres, punctures etc…

Terms and Conditions – Additional Clauses
We are hesitant to hire travel / portable scooters and powerchairs beyond our normal coverage area as we are not in a position to swap out hire equipment if the equipment does develop an issue. Thus, we have to have amended terms and conditions to reflect hires beyond our normal/local coverage area.
If the client or client representatives hired Scooterland Mobility’s equipments without properly informing us that they are going outside the scope of Scooterland Mobility Coverage Zone (Gold Coast). The client/client rep is solely liable and responsible for all damage incurred during the hiring process and is responsible for the repair cost as well as the agreed-upon hiring cost.
The amended hire agreement includes an undertaking or guarantee from the client that they shall first try and find a local entity to offer a quote to rectify any issue (if feasible) or arrange (at the clients’ cost) to have the hire equipment returned to us for repair or replacement or a combination of either resource to remedy any issue.
If Scooterland Mobilty’s Equipment fails or receives damage during the hiring period, the client cannot use that as an excuse or valid reason to avoid hiring fees/non-payments wether or not they inform Scooterland Mobility. The client is still liable for the hire cost and damages incurred during the hiring process even if the product is non-functionally due to damages incurred during the hiring process.
Duty of Care
The hirer has a duty of care to maintain the hire equipment, that the hirer shall not operate the equipment in wet conditions, that the hirer shall not operate the equipment beyond its operating parameters and that the hirer returned to equipment back to us as per the hire period as agreed at the onset of the hire.
Notice
By agreeing either verbally or by written (email) acknowledgement to proceed with the hire and/or providing payment for the hire, the hirer has deemed to agree to the charges, and to the terms and conditions printed on the back of this hire agreement and published on our website.
Equipment Failure
With respect to equipment failure we have the following statement:
Travel Hire
The client shall first try and find a local entity to offer a quote to rectify any issue (if feasible) or
The client shall arrange (at the client’s cost) to have the hired equipment returned to us for repair or replacement or a combination of either resource to remedy any issue.
Local Hire
Our standard call-out fee will be charged for any call-out/service call requests (including punctures), found not to be acceptable equipment failure, for local hire, for clarity local is deemed to be within 30km of Scooterland’s premises.
Furthermore, if the client requests us to remedy an issue, i.e. collect the hire equipment and /or replace such (if feasible), then our standard call-out rate shall apply for the scope of the request and is subject to prior commitments/availability.
Metro Hire
Our standard workshop hourly labour will be charged for any call-out/service call requests (including punctures), found not to be acceptable equipment failure, for hires beyond the Gold Coast (i.e. Brisbane), for clarity this is deemed to be beyond 30km of Scooterland’s premises
Furthermore, if the client requests us to remedy the issue, i.e. collect the hire equipment and/or replace such (if feasible), then our standard workshop hourly labour rate shall apply for the scope of the request and is subject to prior commitments/availability.
Clauses
The applicable rates apply during normal working hours and a normal working week.
Public Holidays, Weekends and After Hour requests will have the applicable rate loading charge applied to our standard call-out rate and/or workshop hourly labour rate.
Bond / Deposit
We don’t normally take bond/deposit but have to for hires beyond our normal coverage area, this bond acts as a form of guarantee to be used if needed to cover costs associated with the return of hire equipment if in the event the hire equipment has to be returned to us by a third party.
Liability
Our rental agreements basically the state’s the following;
The hirer acknowledges that the use of the item/s has the potential to cause injury, damage or loss to both the hirer and any other person or property, and further acknowledges that this use is entirely at their own risk.
The hirer accepts total liability should any claim be made by any person or persons in respect to any injury or damage caused by the hirer whilst he or she is in charge or control of the item/s. (Control being the total time hired by the hirer both start and end dates inclusive).
In consideration of this contract to hire, the hirer absolutely releases Scooterland Mobility, its servants and agents for all liabilities, loss or demands made by any person or entity, as a result of any act or omission by the hirer whilst in possession or control of the item/s. This includes but is not limited to death, personal injury, property loss or damage to the hirer or any other persons howsoever such damage or loss may be caused either wholly or in part by any act or omission by the hirer.
